We do not tolerate SPAM (unsolicited commercial Email). SPAM is a plague on the Internet.

The following activities are expressly prohibited:

1. SPAM / Unsolicited Commercial Email (UCE)

Do not SPAM, facilitate SPAM or allow your customers to SPAM. Do not host, or allow to be hosted, any sites or information that is advertised by SPAM from other networks. Violation of this policy carries severe penalties and will be pursued to the fullest extent possible including criminal and civil prosecution.

We understand that there will be a few complaints any time large quantities of Email are sent. However, BuyAsun.com must respond promptly to SPAM complaints in order to prevent our IP address space from being blocked.

Your service will be disconnected without refund if:

You don't have an opt-in list. We expect you to be able to respond to complaints with the source of the person's Email address who complained. The use of "harvested" email lists where addresses have been taken from web sites is grounds for immediate termination of service.

You don't have a removal process that permanently removes recipients from your lists and sends confirmations via Email.

You forge header information or improperly identify the sender.

You don't respond to inquiries from BuyAsun.com Abuse within one business day.

Anti-SPAM actions against you threaten BuyAsun.com's network or IP address space.

After your first warning from the BuyAsun.com Abuse Department you will be charged at $99 / hour if we must further process SPAM complaints. In the event that emergency action is required by BuyAsun.com to resolve actions by anti-SPAM organizations to blacklist BuyAsun.com IP addresses or other threats to the BuyAsun.com you will be charged at our emergency double-time rate of $198 / hour with a one hour minimum.

Do not setup an open mail relay that is not password protected that can allow spammers to send SPAM. Please contact us if you have questions.

2. Hacking or any perpetration of security breaches

3. Illegal activities

4. Child pornography or any activities harmful to minors.

5. Fraudulent activity

6. Trademark or Copyright infringement including use or distribution of pirated software.

7. Utilization of Microsoft software that is not properly licensed.

8. Network attacks or any unfriendly effort to effect service on another network or server.

9. Virus distribution.

10. Adult Material - Adult materials are allowed to be hosted on our servers. However they must be legally owned by you or you have the right to re-distribute them. Sites found that contain any illegal adult materials will be suspended or terminated immediately.

11. Game ROMs, copyrighted MP3s, warez, software cracks distribution.

12. IRC activity linked to any major IRC network.

13. Network security and Server Abuse: Any attempt to undermine or cause harm to the server(s), or customer(s), of BuyAsun.com Network.

14. Cron jobs: No cron job may run more than once every five minutes, any account found violating this will be suspended immediately or terminated if it is affecting the server performance.

15. Mass mailing: BuyAsun.com does not host any account performing mass mailing of any sort. Each account is only allowed to send 50 email messages per 10 minutes, any further email messages sent will be blocked. This limit is more than enough for normal web sites which maintain small scale mailing lists. If your account would/does exceed this limit, you should outsource your mailings to a 3rd party provider. Other than that, if for any reason the mass mailing activity is affecting the performance of our servers, the associated account(s) will be terminated immediately.

16. Resellers are responsible for enforcing the AUP and TOS to all of their clients. If their clients are found to be not following them, BuyAsun.com will suspend the offending site and let the reseller know. Resellers are responsible for anything their clients do. Investigations, disruptions to service, no refunds:

We reserve the right to disable service or terminate service and / or remove content in order to investigate suspected violations of this AUP without first giving notice.

You are responsible for the use of your account, including transfer and bandwidth, even used by unauthorized users or hackers.

Please note that this AUP is subject to change and it is the Customer's responsibility to regularly check for modifications.

BuyAsun.com does not issue refunds for terminating service due to suspected AUP violations.
